Josh Katz to Speak at TCAA Summer Conference

BHDA partner Joshua D. Katz will participate in a panel discussion titled “Perspectives on City Authority in the ETJ” at the annual Texas City Attorneys Association (TCAA) Summer Conference on June 12, 2024.

Mr. Katz will be joined by two other panelists, Robyn Claridy-Miga (Planning & Development Services Assistant Director, City of Pflugerville) and Brad Bullock (Attorney, Messer Fort, PLLC). Their discussion will address recent changes in Texas law related to extraterritorial jurisdiction and the impact on municipal planning and development.

BHDA is a sponsor of TCAA’s 2024 Summer Conference, which will take place June 12th-14th in South Padre Island.

BHDA Litigation Attorneys Present at TCAA Summer Conference

Joshua D. Katz, a partner in the firm’s litigation group, and Daniel J. Olds, an associate in the firm’s litigation group, were presenters at the Texas City Attorneys Association’s (TCAA) annual summer conference, which was held virtually this year.

Mr. Katz’s presentation addressed walking quorums and the Texas Open Meetings Act, and Mr. Olds discussed the attorney-client relationship for city attorneys in his presentation.

Groundwater Ownership/Regulation: Where We’ve Been and Where We May Be Going

The character of groundwater ownership has received more attention in the last 18 months than in the previous 100 years. The ownership issue is pending before the Texas Supreme Court in Edwards Aquifer Authority v. Day and the Texas Legislature addressed ownership in amendments to Chapter 36 of the Texas Water Code. This paper reviews groundwater district permitting in the context of changes made by the 82nd Legislature and what a takings claim might look like post EAA v Day.
