Presented at the Changing Face of Water Rights course in San Antonio on February 27, 2014, this paper examines the Bragg and Day cases and what they signal for both groundwater owners and groundwater conservation districts. Going forward, what permitting actions of a groundwater district might constitute a regulatory taking of private property rights?
